Terms and Conditions

These Terms and Conditions were last updated on 1st May 2023 and the updates take effect from
that date.

1. General


WOLFDEN TERMS OF SERVICE

The Wolfden Platform is made available by Wolf Den Services Pty Ltd (ACN 655 943 865) and our affiliated companies(Wolfden, us, our or we) to you (you or your) subject to these Terms of Service and the Privacy Policy. Please read these Terms of Service carefully before you use the Wolfden Platform. By using the Wolfden Platform, you agree to become bound by these Terms of Service and the Privacy Policy as updated from time to time, whether you are using the Wolfden Platform as a guest or a user with a Wolfden account.

  1. Wolfden Platform
    1. Wolfden is not a bookmaking or wagering service. No bets are received by Wolfden.
    1. We provide the Wolfden Platform on an “as is” basis. To the fullest extent permitted by law, we do not make or give any express or implied representations, conditions or warranties in relation to the Wolfden Platform, including that it will operate uninterrupted, be free from defects or viruses or meet your requirements. You acknowledge that the Wolfden Platform may be unavailable for periods of time (scheduled or unscheduled) for maintenance, updates or upgrades and that we do not represent or warrant that the Wolfden Platform will meet any “uptime” or “availability” targets.
    1. In order to access the Wolfden Platform, you will need to set up a Wolfden account. If you do not have a Wolfden account, you can create one by downloading the Wolfden mobile application.
    1. You represent and warrant that you are at least 18 years old. If you do not meet these requirements you must not create a Wolfden account or use the Wolfden Platform.
    1. You are responsible for choosing an appropriate username and password for your Wolfden account and for keeping the password secure. You are liable for all charges incurred on your Wolfden account. Wolfden is not liable for any activity or unlawful or unauthorised access of the Wolfden Platform.

    • When using the Wolfden Platform, you must not take any action or use the Wolfden Platform in any way that might:
      • bring Wolfden into disrepute;
      • affect the ability of Wolfden to provide the Wolfden Platform;
      • be illegal or encourage or permit illegal activities;
      • be libellous, misleading or defamatory;
      • infringe any third party’s rights (including intellectual property rights).
    • Except as expressly described in these Terms of Service, you must not attempt to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, distribute, decompile, disassemble, reverse engineer or otherwise reduce to human-perceivable form all or any portion of the Wolfden Platform, or access the Wolfden Platform in order to build a product or service which competes with the Wolfden Platform or any other product or service offered by Wolfden from time to time.
    • We may, at our sole discretion, restrict your access to the Wolfden Platform where reasonably required from time to time.
    • Certain aspects of the Wolfden Platform may incur a Fee. If you elect to use paid aspects of the Wolfden Platform, you agree to the pricing and payment listed by Wolfden, which we may update from time to time. We may add new services or features, or amend the fees or charges for existing services, at any time, on notice to you, at our sole discretion.
    • If you purchase any Membership Packages and/or Subscriptions, we will automatically charge Fees for your applicable purchase to the debit or credit card nominated at the applicable frequency set out at the Point of Purchase. We accept Visa, MasterCard and American Express Cards, or such other cards we notify you that we accept.
    • It is your responsibility to ensure that:
      • your debit or credit card details (as applicable) are always valid and up to date;
      • sufficient funds are available each month; and
      • the billing address and other necessary information you have provided are always valid and up to date.
    • All Fees will be billed by us (and therefore charged to your nominated debit card or credit card) weekly in advance. Notwithstanding, we reserve the right to bill you at other intervals and will provide you with reasonable notice prior to processing such billing.
    • We are not liable for any charges you incur as a result of incorrect payment information. If we incur an expense due to incorrect payment information provided by you, we reserve the right to seek reimbursement from you for such expense.
    • If we are unable to process your payment:
      • you authorise us to reattempt the payment method a maximum of four times over a four-week period;
      • if such reattempts are unsuccessful, we reserve the right to:
        • seek payment from you via an alternative payment method and/or seek to recover the debt through alternative means (either directly, or through a third party) and you will be responsible for all costs and expenses incurred by us in connection with such collection activity, including collection fees, court costs and attorneys’ fees;
        • seek reimbursement for any costs we incur when reattempting payment; and
        • suspend your use of your account and access to Wolfden Platform until all overdue amounts are paid.
    • If you believe that there has been an error in charging your nominated debit card or credit card (as applicable), you can contact us to confirm the details of the disputed charge at support@wolfden.win. We will then investigate the matter and advise you in writing whether your debit or credit card (as applicable) has been incorrectly or correctly charged along with any other necessary details. If the parties cannot resolve the matter, you must contact your debit card or credit card provider (as applicable).
  • Cancellation and terminating access to the platform
    • You may cancel your Membership Packages and/or Subscriptions at any time via your account. Your Membership Packages and/or Subscriptions will be cancelled at the end of the then-current billing period.
    • We look forward to providing you with access to and use of the Wolfden Platform for so long as you wish to have it. However, there are some circumstances under which your access or use of the Wolfden Platform may be limited or suspended or your Wolfden account may be terminated to protect the security and integrity of the platform and/or to preserve the value of the Wolfden Platform, including if:
      • in our reasonable opinion, you may be infringing the rights of third parties (including intellectual property rights);
      • you commit a material breach (or your actions are likely to result in a material breach) of these Terms of Service;
      • we reasonably consider that your acts or omissions may threaten the security of the Wolfden Platform or any third party, including the distribution of any malicious malware or viruses;
      • in our reasonable opinion, you are rude or abusive towards other members of the Wolfden Platform or a member/s of the Wolfden community;
      • you use data scraping (or similar automated extraction tools) to extract information from the Wolfden Platform;
      • you fail to pay any fees or other charges as and when they are due and payable; or
      • in our reasonable opinion, we consider it necessary given your past, current or anticipated behaviour, conduct, acts or omissions.
  • Intellectual property
    • You acknowledge that all intellectual property rights in the Wolfden Platform belong to Wolfden. You will not acquire any rights to the Wolfden Platform (or the intellectual property rights contained in it) from your use of the Wolfden Platform, other than as expressly described in these Terms of Service.
    • Subject to your compliance with these Terms of Service, including where applicable, payment of fees owed by you to us, we grant you a limited, non-exclusive, non-transferable licence to view, access and use the Wolfden Platform for such time as it is made available by us strictly in accordance with these Terms of Service.
  • Collection and use of your data
    • In order to access the Wolfden Platform, you may be required to provide information about yourself, such as your name, address and billing details. Our Privacy Policy explains how we treat your personal data and protect your privacy when using our services. Any such information you provide to Wolfden must always be accurate, correct, up-to-date and comply with our Privacy Policy.
    • You agree that we can collect and use Usage Data to identify errors in the Wolfden Platform and monitor usage statistics for further development or implementation of improvements; and/or to compile statistical and performance information. You agree that we can incorporate or use any suggestions, enhancements, recommendations or other feedback received from you (either directly or indirectly) into the Wolfden Platform or any other Wolfden goods or services.
  • Limitation of liability
    • While Wolfden believes in the accuracy of its form guide, analysis and tips, these are not guarantees, and past results are not an indication of future earnings. You should be aware that betting is a form of gambling which inherently involves a degree of risk. Wolfden is not responsible for your losses in respect of any losses suffered in connection with Wolfden AI.
    • To the maximum extent permitted by law, Wolfden excludes and will not be liable in contract, tort (including negligence), breach of statutory duty or otherwise for any: indirect or consequential loss; loss of profits; loss of revenue; loss of anticipated savings; loss of business or business opportunity; loss of goodwill; or loss of or corruption to data. Wolfden’s total liability in contract, tort (including negligence), breach of statutory duty or otherwise for any claims arising under or in connection with this agreement is limited to AUD $500.
    • Nothing in these Terms of Service will exclude or limit Wolfden’s liability for: death or personal injury caused by the negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited by law.
    • We aim to continually improve the delivery and content of the Wolfden Platform and accordingly may make changes to the Wolfden Platform from time to time. New features may be added, but we may also modify or discontinue (temporarily or permanently) components of the Wolfden Platform, in part or in whole. We may occasionally make changes to these Terms of Service and will notify you of material changes via email or notification to your Wolfden account. If Wolfden does make changes to these Terms of Service, all changes will go into effect at the time we post the updated Terms of Service on our website and mobile application. Your continued use of the Wolfden Platform will be taken to be acceptance of any amended Terms of Service.
  • General
    • These Terms of Service are governed by the laws of New South Wales, Australia and any dispute will be heard by the courts in New South Wales, Australia.
    • You may not assign your rights under these Terms of Service and any attempted assignment will be void from the beginning.
    • Failure by Wolfden to enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
    • If any part of these Terms of Service is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent or be severed from the agreement and the remaining portions will remain in full force and effect.
    • The terms of these Terms of Service reflect the entire agreement between the parties with respect of the subject matter.
    • Any notices should be sent by registered by post to Wolfden, Strategic Wealth Management Pty Ltd, Suite 234, 7-11 The Avenue, Hurstville NSW 2220.
  • Definitions
    • Unless context otherwise requires:
      • (a)        Customised Subscription has the meaning given to it at clause 5.1.
      • Den Dollars means Wolfden’s virtual currency which users can purchase and use in the Wolfden platform.
      • Fees means the fees payable for the Den Dollars, Membership Packages and/or Subscriptions, as set out at the point of purchase and/or varied in accordance with these Terms of Service.
      • Membership Packages means the categories of subscriptions available for purchase as set out at clause 4.
      • Point of Purchase means the point at which you subscribe to, and purchase, the Den Dollars, Membership Packages and/or Subscriptions including via our website.
      • Popular Subscription has the meaning given to it at clause 5.1.
      • Race has the meaning given to that term at clause 1.1.
      • Terms of Service means the terms and conditions set out in these terms of service (as updated from time to time).
      • Trade Promotion means the prize draws operated by Wolfden on a monthly basis (or other frequency determined by Wolfden) which users choose to enter (subject to the applicable Trade Promotion terms).
      • (k)         Usage Data means data and information relating to or arising from your use of the Wolfden Platform, including data regarding the duration, consistency and manner of your access or use of the Wolfden Platform.
      • Wolfden AI means Wolfden’s form guide product which users can purchase access to in respect of Races.  
      • Wolfden Platform means the website located at www.wolfden.win (or such other location as notified by Wolfden) and mobile application.
      • Subscription has the meaning given to it as clause 5.1.

Entrants Entry is open to Wolfden members who are over the age of 18 at the time of the Promotion Period, and who make a valid entry as per the Entry Procedure prior to the end of each Monthly Promotion Period.
Exclusions
Employees of the Promoter and the suppliers and agencies associated with this Promotion, and the immediate family of all such employees, and any person involved in the management of any organisation which will benefit from the Promotion.
Promotion Period Starts at 12:00 AM on 19 February 2024 on and ends at 12:00 AM on 30 November 2024.
Entry Procedure To enter the promotion: Members who have purchased a WolfdenAi product or Membership Package during the Promotional Period gain automatic entry into a monthly draw for the same month that member purchases a WolfdenAi product or Membership Package (‘Relevant Monthly Draw’). The number of tickets allocated to each Entrant will be as follows:Bronze Membership Package: 5 tickets per week in the Relevant Monthly DrawSilver Membership Package: 10 tickets per week in the Relevant Monthly Draw Gold Membership Package: 20 tickets per week in the Relevant Monthly Draw Diamond Membership Package: 400 tickets per week in the Relevant Monthly DrawMembers who have purchased a WolfdenAi product or Membership and have earned any competition tokens via their participation in Wolfden competitions during the Promotion Period, may elect to redeem their competition tokens by way of member draw tickets for the same month in which those competition tokens were earned. Draw Details: Winner Determination. One (1) prize winner will be selected for each Monthly Draw using a randomised computer-generated number selector. The winner will be the first valid entry drawn.The draw for each promotion will take place at 12:00 PM on the Draw Date as outlined in Promotion Details at Level 5/17-19 Alberta St, Sydney, NSW 2010.  
Prize Details Total Prize value is $90,000. One (1) winner will be drawn each month and will be awarded the monthly prize of AUD$10,000.
Prize Restrictions The winner must be at least 18 years of age. If requested by the Promoter, the winner must produce proof of age and residency.The prize cannot be transferred.  
Notification of Winners Winners will be notified by email and in-app following the Relevant Monthly Draw, within 5 business date of the relevant Monthly Draw. It is the Member’s responsibility to ensure their account details are complete and up to date.  
Publication Details Winner’s names will be announced in-app.
Prize Claim Date Winners must have claimed the prize by 17.00 AEST within 5 business days from the relevant Draw Date.
Unclaimed Prize Arrangements
An unclaimed Prize draw will be held at 11:00 hours AEST on the last Wednesday of the month or as specified in the Table below at Wolf Den Services, Level 5/17-19 Alberta St, Sydney, NSW 2010 (Unclaimed Prize Draw).

The winner of the Unclaimed Prize Draw (Unclaimed Prize Winner) will be notified in writing via email or telephone (depending on method of entry) within two days of the Unclaimed Prize Draw. The Unclaimed Prize Winner will be published in the same manner as set out under Publication for a minimum of 28 days on and from the date of the Unclaimed Prize Draw.

Trade Promotion: Game of Chance Conditions of Entry

  1. These Conditions of Entry incorporate and must be read together with the Schedule for this Promotion. The Schedule prevails to the extent of any inconsistency with these Conditions of Entry. Participation in the Promotion constitutes acceptance of these Conditions of Entry.
  2. Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, except where stated otherwise.
  3. These Terms & Conditions may be amended or replaced by the Promoter at its discretion at any time. 
  4. This Promotion is a game of chance. 
  5. The winner(s) of the Prize(s) will be drawn electronically at the relevant Draw Date from all entries received during the Monthly Promotion Period.  The result of the Relevant Monthly Draw is final and the Promoter will not enter into correspondence regarding the result.

Eligibility

  1. Entry to the Promotion is open to residents of the Relevant State/s who meet the Entry Restrictions (if any).
  2. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or organisations associated with this Promotion are ineligible to enter. “Immediate families” means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.

Entry

  1. The Promotion will be conducted during each Promotion Period as outlined in the Schedule.
  2. To enter a Promotion, entrants must complete the Entry Procedure during the Promotion Period.
  3. Entries may only be submitted in accordance with the Entry Procedure and will not be accepted by the Promoter in any other form. Computer generated will not be accepted. Once submitted, entries may not be altered or deleted.
  4. Entries must be received by the Promoter during the Promotion Period.

Entry Content

  1. Entrants are required to take full responsibility for ensuring that their entry complies with these Conditions of Entry.
  2. Incomplete and ineligible entries will be deemed invalid. Entries will also be deemed invalid if they breach these Conditions of Entry as determined by the Promoter in its sole discretion or any other content guidelines notified by the Promoter during the entry process for the Promotion.
  3. The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry.

Facebook, Instagram and X (Twitter) promotions

If the Promotion is conducted via the Facebook, Instagram and X Platforms:

  1. Entrants acknowledge that the Promotion is in no way sponsored, endorsed, or administered by, or associated with, Facebook, Instagram and X.
  2. Entrants acknowledge that any information they provide in connection with the Promotion is provided to the Promoter and not to Facebook, Instagram and X.
  3. Any questions, comments or complaints regarding the Promotion will be directed to the Promoter, not to Facebook, Instagram and X.
  4. Entrants release Facebook, Instagram and X, and their associated companies from all liability arising in respect of the Promotion.

Determining and notifying winners

  1. The prize draw(s) will be conducted in accordance with the Draw Details. The prize(s) will be awarded to the first valid entry (as applicable) drawn in accordance with the Prize Details.
  2. Winners will be notified as specified in the Schedule and their name and State/Territory of residence will be published in accordance with the Schedule. The Promoter and the companies and agencies associated with this Promotion may also publish the name and State/Territory of winners on their website(s) and in trade publications.
  3. To be eligible to claim any prizes from the promotion, the winner’s Wolfden account must have successfully completed the email verification process at the time of registration on the Platform. If the winner has provided an incorrect email address during registration and is unable to complete the verification process, said winner will be deemed ineligible to claim any prizes, irrespective of their standing in the Promotion. It remains the winner’s responsibility to ensure accurate information is provided during registration and entry into the Promotion. Any failure to provide accurate information may result in disqualification from the Promotion and forfeiture of any potential prizes.
  4. Email Verification Process 
    1. Users are required to provide a valid and active email address during the registration process on the Platform. 
    1. Failure to complete the verification process within the specified timeframe may result in the user being deemed ineligible to claim any prizes.
  5. Disqualification and Forfeiture of Prizes 
    1. If a user is found to have provided an incorrect email address during registration and is unable to complete the verification process, they will be disqualified from the Promotion. 
    1. Disqualification will result in the forfeiture of any potential prizes, irrespective of the user’s standing in the Promotion. 
    1. The Promoter reserves the right to verify the accuracy of the information provided by users and disqualify any participant who fails to provide accurate information.
  6. User Responsibility 
    1. Users are solely responsible for providing accurate and up-to-date information during the registration and entry into the Promotion. 
    1. The Promoter shall not be held liable for any consequences arising from the provision of incorrect or inaccurate information by users.
  7. Technical Issues 
    1. In the event of technical issues preventing users from completing the email verification process, users should promptly contact the Promoter’s support team for assistance. 
    1. The Promoter will make reasonable efforts to resolve any technical issues promptly but shall not be held responsible for any delays or failures in the email verification process.
  8. By participating in the Wolfden Promotion, users acknowledge and agree to comply with the email verification requirement as outlined in these Terms and Conditions. The Promoter reserves the right to modify, amend, or cancel the verification process or these Terms and Conditions at any time, without prior notice, and in its sole discretion.

Prizes

The prize(s) are specified in the Prize Details.

  1. The prize(s) are subject to any restrictions specified in the Schedule. The total monthly prize pool is AUD$10,000.
  2. Any changes to the total Prize value is at the discretion of Wolfden and changes will be communicated via the app and in the Terms and Conditions.
  3. Prizes will be paid into the winner’s nominated bank account within ten (10) business days from the Claim Date.
  4. Prizes are non-transferable, and non-exchangeable.

Claiming prizes

  1. Prizes must be claimed by the Prize Claim Date in accordance with any claim instructions set out in the Schedule. For any enquiries, please email: support@wolfden.win
  2. Correspondence will only be made direct with the email address and contact details listed in the winner’s Wolfden account. It is the winner’s responsibility to ensure the account information is up to date and complete. 
  3. If a prize is not accepted or claimed by the Prize Claim Date, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the unclaimed prizes in accordance with the Unclaimed Prize Arrangements specified in the Schedule, subject to any directions given by any relevant authority.
  4. The winners’ Wolfden account must be email verified to be eligible to claim any prize.
  5. Winner’s must provide proof of residence to claim the prize. Residents of South Australia are excluded from this promotion.
  6. The winner must be over 18 years of age to claim the prizes and have an active Wolfden account at the time of claiming the prize. 
  7. Payment of prize: The money would need to be transferred from Wolfden business account to the players nominated bank account within 10 business days of claim date. Wolfden accepts no responsibility or liability for incorrect bank details provided.
  8. If a prize is not accepted or claimed by the Prize Claim Date, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the unclaimed prizes in accordance with the Unclaimed Prize Arrangements specified in the Schedule, subject to any directions given by any relevant authority. Winners of unclaimed prizes will be notified and have their names and State/Territory of residence published in accordance with the Unclaimed Prize Arrangements. 
  9. The winners’ Wolfden account must be email verified to be eligible to claim any prize. Participation in Wolfden Promotion (‘the Promotion”) is open to all registered users of the Wolfden platform (‘the Platform’).
  10. To be eligible to claim any prize from the Promotion, users must have successfully completed the verification process at the time of registration on the Platform. In the event that a user has provided an incorrect email address during registration and is unable to complete the verification process, said user will be deemed ineligible to claim any prizes, irrespective of their standing in the Promotion. It remains the user’s responsibility to ensure accurate information is provided during registration and entry into the Promotion. Any failure to provide accurate information may result in disqualification from the Promotion and forfeiture of any potential prizes.
  11. Email Verification Process 
    1. Users are required to provide a valid and active email address during the registration process on the Platform. 
    1. Failure to complete the verification process within the specified timeframe may result in the user being deemed ineligible to claim any prizes.
  12. Disqualification and Forfeiture of Prizes 
    1. If a user is found to have provided an incorrect email address during registration and is unable to complete the verification process, they will be disqualified from the Promotion. 
    1. Disqualification will result in the forfeiture of any potential prizes, irrespective of the user’s standing in the Promotion. 
    1. The Promoter reserves the right to verify the accuracy of the information provided by users and disqualify any participant who fails to provide accurate information.
  13. User Responsibility 
    1. Users are solely responsible for providing accurate and up-to-date information during the registration and entry into the Promotion and prize claims.

It is the sole responsibility of the claimant to ensure the accuracy of the bank information provided before submitting them for prize claims.     1. In the event of technical issues preventing users from completing the email verification process, users should promptly contact the Promoter’s support team for assistance. 
    1. The Promoter will make reasonable efforts to resolve any technical issues promptly but shall not be held responsible for any delays or failures in the email verification process.
  15. By participating in the Wolfden Promotion, users acknowledge and agree to comply with the email verification requirement as outlined in these Terms and Conditions. The Promoter reserves the right to modify, amend, or cancel the verification process or these Terms and Conditions at any time, without prior notice, and in its sole discretion.
  16. Prizes are non-transferable, non-exchangeable and non-refundable for cash or any other form of compensation. 

General

  1. The Promoter accepts no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted, or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) any costs incurred.
  2. The Promoter may, at its sole discretion, declare any or all entries made by an entrant invalid, and prohibit further participation by an entrant in this Promotion, if the entrant:

  4. tampers with or benefits from any tampering with the entry process or the operation of the Promotion;

  6. acts in a disruptive manner or with the intent to annoy, abuse, threaten or harass any other person; or
  7. engages in conduct in entering the Promotion which in the Promoter’s opinion is fraudulent, misleading, deceptive, or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes where entrants share receipts or product labels to enter the Promotion or where entrants use multiple names or addresses to register multiple entries.
  8. Entrants must comply with the Verification Requirements. The Promoter may require entrants to provide these to the Promoter or its agent as part of the entry verification or prize claim process. Failure to provide these to the Promoter’s satisfaction will result in the relevant entry being declared invalid (and, at the Promoter’s discretion, in all of the entrant’s entries being declared invalid).
  9. All entries will be the property of the Promoter and will not be returned.
  10. Prizes are not transferable or exchangeable and, except for cash prizes, cannot be redeemed for cash or any other form of compensation. The value of each prize is accurate as at the time of preparation of this material. The Promoter accepts no responsibility for any variation in the value of a prize after that date. If a prize is unavailable for any reason, the Promoter may substitute it for another item of equal or higher value, subject to the approval of the relevant authorities in the Relevant State(s), if required. If a winner does not take an element of a prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation will be supplied in lieu of that element of the Prize. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if any prize (or any part of a prize) is unavailable for any reason.

If requested by the Promoter, entrants, and winners (or their companion(s), if applicable) must sign (or procure that their parent/guardian signs) an indemnity and exclusion of liability form provided by the Promoter, in favour of the Promoter and all parties involved in this Promotion and/or providing the prize, before they participate in the Promotion and/or the prize. If they or their parent/guardian do not sign that form within the time specified by the Promoter, they will not be able to participate and the relevant entrant’s or winner’s entry or claim will be deemed invalid. Where an entry is declared invalid prior to the Prize Claim Date, the Promoter may determine a new winner in accordance with the Unclaimed Prize Arrangements.

If requested by the Promoter, entrants, and winners (and their companion(s), if applicable) must participate in all promotional activity (such as publicity and photography) surrounding this Promotion or their winning of a prize, free of charge, and they consent to the Promoter and its associated companies and agencies using their name and image in promotional material.

If for any reason any aspect of this Promotion does not or is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to the approval of the relevant authorities in the Relevant State(s), if required.
  14. The Promoter’s decisions in connection with the Promotion are final and no correspondence will be entered into.

Entrants acknowledge that there may be inherent risks in some aspects of the Promotion or the prize and that participation in the Promotion or the prize may involve participating in dangerous activities. The Promoter may at its absolute discretion prohibit an entrant’s participation in this Promotion, cancel or suspend a prize or other cease to provide any prize to a winner if the entrant or winner (or any companion) is (in the Promoter’s opinion) under the influence of alcohol or drugs, behaves aggressively or disruptively, or behaves in a manner which may diminish the good name and reputation of the Promoter or its products and brands, or is contrary to law or is otherwise inappropriate.
  21. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
